Police Find No Evidence of Attack Amid Homeless Man's Battery Claims

The man said another homeless man punched him in the face and showed him a gun Saturday outside 7-Eleven, but police did not find a weapon on the suspect.

were called to 7-Eleven, 5105 Fairview Ave., Saturday afternoon after getting reports of a battery but said they found no evidence of an attack when they arrived.

A homeless man, who police said was drunk, told officers another homeless man punched him in the face as he slept on the ground outside the store. The man said he was resting by the 7-Eleven because he is not allowed in Hummer Park with his friends.

Police said the victim claimed the other homeless man pointed a handgun at his head and said, “Stay the **** out of my turf, you’re no longer welcome here,” before walking toward Hummer Park. The victim was uncertain when or where the incident occurred and gave the police several different versions of the story, according to the report.

Officers did not see any signs of injury on the man’s face, the report said.

The man declined treatment and told police he called them just to document the incident in case something similar happened again.

Police located the suspect, who they said was also drunk, in Hummer Park. The man denied getting into a fight with anyone, police said. He told police he went to 7-Eleven three hours earlier to buy a beer but had not left the park since.

The man told police he did not own a gun. Officers searched him and said they didn’t find any weapons. The man’s hands did not show any signs of injury consistent with hitting someone, police said.

A third homeless man who the victim said witnessed the incident told police he did not see anyone get hit, the report said.

No charges were filed.
