Triple Murder, Student Sex Abuse, Luring a Minor: Court Watch

Patch catches you up on some of DuPage County's high-profile court cases.

The following are recent developments in notable DuPage County court cases:

Trial Date Set for Triple-Murder Case

Darien: Attorneys in Johnny Borizov's triple-murder case have their eyes on a new trial date in the 2010 incident—April 2013. During a hearing this week, Judge Daniel Guerin gave the case its second scheduled trial date after a planned January trial was bumped because of an attorney's conflict. Borizov is accused in the shooting deaths of three members of the Kramer family in March 2010, in a scheme that intended to kill Angela Kramer, the mother of Borizov's son. Jacob Nodarse, Borizov's codefendant, pleaded guilty, but mentally ill, a year ago to a single murder count in a deal with prosecutors to secure his testimony against Borizov. Nodarse faces a minimum of 45 years in prison when he is eventually sentenced after testifying.

Trial Date Set for Naperville North Counselor Charged with Criminal Sex Abuse

Naperville: A January trial date has been set in the case of a former Naperville North High School counselor accused of criminal sex abuse involving a 16-year-old student. John Carbonaro was arrested in February 2011 after a concerned parent notified school officials about a relationship Carbonaro had with the girl. School officials turned to police to begin the investigation that eventually led to the charges. Carbonaro has pleaded not guilty in the case.

Man Accused of Aggravated DUI Asks Judge to Suppress Evidence

Naperville: The Plainfield man accused of aggravated driving under the influence and leaving the scene of a fatal accident wants a judge to suppress evidence and statements police obtained from him. Michael Moreno is charged in connection to the June crash involving a motorcyclist from Lombard, 63-year-old Gerald Puglise, who died at the scene. Moreno claims he was "in a state of shock and trauma" after the crash, leaving him unable to properly waive his Miranda rights. He also alleges police threatened him the use of a catheter to extract a urine sample if he did not submit blood and urine. Moreno wants prosecutors to be barred from using anything he said in the interview, as well as the results of the blood and urine tests, at trial, court records show. Moreno remains in DuPage County Jail on $500,000 bail.

Arraignment Set for Man Accused of Arranging Sex with 12-Year-Old Girl

Wheaton: Arraignment is scheduled for Oct. 1 in the case of a Naperville man accused of making arrangements with a 12-year-old girl to meet at the Wheaton Library for sexual activity. Eric Pence, 19, was charged with possession of child pornography, luring a minor and traveling to meet a minor in connection to an investigation of communications he had with the girl in June. Court records indicate he also possessed lewd images of a young girl. Pence is being held in DuPage County Jail on $200,000 bail. Court records indicate Pence's father, also named Eric, has at least 13 years left on a prison sentence for sex assault convictions in DuPage and McHenry counties from 2005.
