Downers Grove to Pay $132K Settlement to Motorist Struck by Police Car

The village council on Tuesday unanimously approved a settlement with David Rosa, whose vehicle was struck by a patrol car on Ogden Avenue in August 2011.

The village of Downers Grove will pay a $132,000 settlement to a man whose vehicle was struck by a police car in 2011.

The village council voted unanimously Aug. 13 to approve a settlement with Chicago resident David Rosa using money from the Risk Fund. There was no discussion on the resolution, which was part of the council's consent agenda.

On Aug. 12, 2011, Rosa was driving a vehicle eastbound on Ogden Avenue with his friend, William Keim, according to a lawsuit filed in DuPage County Circuit Court. The lawsuit states that Downers Grove Police Officer Craig Widlacki failed to yield when he turned from Washington Street onto Ogden Avenue, and that his squad car collided with Rosa's vehicle.

Rosa and Keim, both sustained injuries for which they received medical treatment and lost time from work, according to village documents. They sued Widlacki and the village of Downers Grove in 2012 for damages in excess of $50,000.

Because Rosa has completed medical treatment, his claim is settled. Keim's case is still pending, according to village documents.
